Read this in 30 seconds: Overstaying by one day is already a violation. Under 16 days, it's usually a lower-tier fine. But from 16 days onward, on top of the fine, deportation can be applied. The longer you stay, the faster the fines climb. The safest move: never leave it to the last day.
What changed?
Since 15 December 2025, Decree 282/2025/NĐ-CP on administrative penalties in the field of security and public order has been in force, replacing Decree 144/2021/NĐ-CP. Violations involving entry, exit, transit, residence and movement of foreigners are set out in Article 21.
The biggest change is not "all fines doubled" — it's that the decree splits the overstay periods into finer brackets so that longer overstays are punished far more severely. The result: the longer you overstay, the faster the fine climbs — sharply, compared to the old rules.

Also:
- Not carrying your ID/passport while travelling in Vietnam: warning or a fine of VND 300,000 – 500,000.
- Sponsoring organizations/companies whose foreign nationals violate: fines are double the individual amounts above.

Deportation and the blacklist
This is what people underestimate most.
- Deportation is an additional penalty — meaning it comes on top of the fine, not instead of it.
- It can apply to overstays of 16 days or more, depending on the nature and severity of the violation and how forthcoming you are in declaring it.
- Long overstays or repeat violations can land you on the entry-ban blacklist — barred from Vietnam for 1 year, 3 years, or longer depending on severity.
In other words: your attitude genuinely matters. Voluntarily reporting early is completely different from being caught during a check.

Already overstayed? Here's what to do
1. Don't run, and don't just "turn up at the airport and see." Once you've overstayed, you can't simply exit as normal. Trying to avoid it makes the consequences far worse.
2. Report it yourself, as early as possible. Go to the Immigration Department or the Immigration Office of the provincial police where you're staying (in Nha Trang: Khanh Hoa Provincial Police).
3. Prepare a written explanation. State clearly why you overstayed (health, unforeseen events, personal oversight…). Supporting documents (e.g. hospital papers) improve your chance of leniency.
4. Pay the fine and get the receipt. Once the penalty decision is issued, you pay and receive official documentation.
5. Exit the country. You'll typically be issued a short-validity exit visa to pack up and leave. You can then apply for a new visa to return through the proper process — provided you're not on the entry-ban list.
Important: an expired visa is no longer valid and generally cannot be extended to keep you in the country.
How to avoid it (much cheaper than paying)
- Count correctly: your entry date is Day 1. A 45-day exemption starting 1 June means you must leave by 15 July at the latest.
- Set a reminder 7–10 days ahead, not one day ahead. You need time to book a trip or arrange paperwork.
- A visa exemption can't be extended in-country. To stay longer: take a Border Run/Visa Run, or use a 90-day E-Visa for your next entry.
- You can't apply for an E-Visa from inside Vietnam. If you're already here, you must exit first — this is exactly why Visa Runs exist.
- Always carry your passport (or at least a clear photo) — not carrying ID is itself finable.
- Stick to your visa's purpose. Working on a tourist visa is a serious violation that can lead to deportation.
